All executive branch agencies within the State of Virginia have been required by the Governor to begin using E-Verify for new hires effective June 1, 2011. E-Verify confirms that new employees are eligible to work in the United States. E-Verify does not replace the I-9 process but provides an extra layer of security for employers to ensure they maintain a legal workforce. E-Verify will be keyed by Human Resources staff after receipt of an I-9 on all new hires for full and part-time Classified, A/P Faculty, Teaching Faculty, Wage and temporary positions. Work Study/Work Scholarship hires will be keyed by Financial Aid staff and Graduate Assistant hires will be keyed by Graduate College staff as these departments are currently responsible for maintaining I-9s separately from HR on these types of hires.
Effective immediately, any advertisement for employment must contain the following E-Verify statement: All new hires will be subject to E-Verify beginning June 1, 2011. E-Verify is administered by the U. S. Department of Homeland Security, USCIS-Verification Division and the Social Security Administration and allows participating employers to electronically verify employment eligibility.
Changes to Form I-9 Process Effective June 1, 2011
The implementation of E-Verify will require slight changes to the I-9 process for new hires. All of the Form I-9 rules that departments followed before E-Verify still apply with the following exceptions:
- All new hires must provide a social security number in Section 1 of the I-9 form (this does not mean that the social security card has to be presented as one form of identification, only that the number is now required on the form)
- Any List B documents that employees present to show identity must contain a photo
- The department completing the Form I-9 must make a copy of the documents presented to show identity and attach to the form. Hiring departments may continue to use the current versions of the Form I-9 (Rev. 08/07/2009) or the previous version (Rev. 02/02/2009) and the current list of acceptable documents on the form as none of these requirements have changed.
